The House of Lords has voted to scrap the government’s proposal to make unfair dismissal a day-one right.
If accepted, the Lords’ amendment would instead simply reduce the current qualifying period for unfair dismissal from two years to six months.
But, approach with caution…
This was a manifesto pledge. The government won’t let it go lightly. It’s highly likely they’ll use their majority in the House of Commons to overturn the amendment and push forward with the original plan of making unfair dismissal a day one right (subject to an initial nine-month probationary period). As always, we’ll update further when we know more.
And so, the ERB saga continues!
There are sure to be more twists and turns before all the proposals hit the statute books, so download our Employment Rights Bill summary and tracker to help stay ahead. Save it to your bookmarks, pin it to your desktop, and stay in the know on all things ERB-related!
